Here's this week's sample CME board review question on EMTALA.
A severely injured, uninsured 50-year-old man arrives at a rural emergency department. The patient requires the services of a level 1 trauma center. The closest trauma center is in another state.
The Emergency Medical Treatment and Active Labor Act (EMTALA) requires hospitals to stabilize unstable patients. If the facility lacks the capability to stabilize the patient, then the patient must be transferred to another facility that can provide necessary treatment.
Question:
What transfer requests may a receiving Medicare-participating hospital refuse under the EMTALA?
Answer Options:
A transfer may be refused when the sending hospital is located in a different state.
A transfer may be refused when the transfer would require the receiving hospital to call in additional staff to provide medical care in excess of the hospital's regular occupancy limits.
